These Terms & Conditions (“Terms”) govern your access to and use of the Watchdog website at https://watchdogvet.com and related services provided by Watchdog (“Watchdog”, “we”, “us”, or “our”).
By accessing the website, requesting a free audit, creating an account, or using Watchdog, you agree to these Terms. If you do not agree, do not use the site or service.
Description of the service
Watchdog helps veterinary clinics identify potential missed billable items by comparing consult notes with invoices and related records.
The service may include:
- This marketing website and related content
- A free audit (or similar evaluation) based on clinic data you authorise us to access or provide
- A paid subscription or other commercial arrangement for ongoing monitoring and reporting, subject to a separate order, proposal, or subscription agreement if we issue one
Watchdog flags potential missed charges. It does not automatically change invoices, post charges, or alter your practice management system (PMS) billing records. Access to your PMS, where configured, is intended to be read-only.
Eligibility and business use
Watchdog is intended for veterinary clinics, practice groups, and their authorised staff (such as practice managers and owners) for business purposes. You confirm that you are authorised to use the service on behalf of your clinic or organisation, and that you can agree to these Terms for that entity.
You must provide accurate information when requesting an audit, contacting us, or creating an account, and keep that information reasonably up to date.
Accounts and acceptable use
If accounts or login credentials are provided, you are responsible for safeguarding them and for activity under your account. Notify us promptly if you suspect unauthorised access.
You agree not to:
- Misuse the website or service, or attempt to disrupt, probe, or compromise security
- Access data you are not authorised to access
- Reverse engineer, scrape, or copy the service except as allowed by law or with our written permission
- Use Watchdog in a way that violates applicable law or third-party rights
- Submit unlawful, misleading, or infringing content
We may suspend or limit access if we reasonably believe you have breached these Terms or present a security or legal risk.
Clinic responsibility for billing decisions
Watchdog provides advisory flags and reports based on available data. Your clinic remains solely responsible for:
- Reviewing all suggestions before acting
- Determining whether a charge is appropriate
- Updating invoices, fees, or clinical records in your PMS or billing systems
- Compliance with professional, regulatory, and client-facing obligations
Watchdog does not make clinical diagnoses, provide veterinary advice, or guarantee that every missed charge will be detected, or that every flag is correct.
Free audits and subscriptions
A free audit is typically offered without charge so you can see recoverable revenue insights from your data before deciding whether to subscribe. Free audits may be subject to eligibility, capacity, and data-access requirements we communicate at the time.
Paid features, pricing, billing periods, and renewals (if any) will be set out in marketing materials, an order form, or a subscription agreement. Unless otherwise agreed in writing, fees are non-refundable except where required by Australian Consumer Law or other non-excludable rights.
Intellectual property
The website, Watchdog software, branding, documentation, and related materials are owned by Watchdog or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the service as provided, for your clinic’s internal business purposes, subject to these Terms.
You retain rights in your clinic’s data. You grant Watchdog a licence to host, process, and use that data as needed to provide and improve the service, produce reports for you, and meet our obligations under these Terms and our Privacy Policy.
You must not remove proprietary notices or use our name or marks without permission, except to refer factually to our service.
Privacy
Personal and clinic information is handled as described in our Privacy Policy. By using the service, you acknowledge that policy.
Disclaimers
To the maximum extent permitted by law:
- The website and service are provided on an “as is” and “as available” basis
- We do not warrant uninterrupted, error-free, or complete detection of all missed charges
- We do not warrant that flags or reports will be accurate in every case or suitable for every decision without your independent review
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other laws that cannot be excluded.
Limitation of liability
To the maximum extent permitted by law, Watchdog (and our officers, employees, and agents) will not be liable for indirect, incidental, special, consequential, or punitive loss; loss of profits, revenue, data, or goodwill; or business interruption, arising from or related to the website or service.
Where liability cannot be excluded, our aggregate liability for claims arising out of or relating to these Terms or the service is limited, at our option, to re-supply of the services or payment of the cost of re-supply, or to the fees you paid us for the service in the three (3) months before the claim (or AUD $100 if no fees were paid), except where Australian Consumer Law or other mandatory law requires otherwise.
Indemnity
You agree to indemnify and hold harmless Watchdog from reasonable claims, losses, and expenses (including legal costs on a solicitor–client basis where appropriate) arising from your misuse of the service, your billing or clinical decisions, your breach of these Terms, or your violation of law or third-party rights, except to the extent caused by our fraud, wilful misconduct, or negligence where liability cannot be limited by law.
Termination
You may stop using the website at any time. Either party may terminate a subscription or audit engagement as agreed in any separate commercial terms, or otherwise on reasonable written notice.
We may suspend or terminate access immediately if you materially breach these Terms, if required by law, or if continued access presents an unacceptable risk. On termination, your right to use the service ends. Provisions that by nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive.
Governing law
These Terms are governed by the laws of Australia. The courts of Australia have non-exclusive jurisdiction, without prejudice to mandatory consumer protections that apply in your state or territory.
Changes to these Terms
We may update these Terms from time to time. The “Last updated” date will change when we do. Material changes may be notified via the website or email where appropriate. Continued use after changes take effect constitutes acceptance, except where applicable law provides otherwise.
